Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the OpenHumancy platform (“OpenHumancy”, “Platform”, “Service”), including websites, web applications, APIs, Telegram bots, Telegram Mini Apps, and related tools and services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Nature of the Platform
OpenHumancy is a technical platform that facilitates interaction between independent users, including systems, applications, or individuals that create tasks (“Requesters”) and independent individuals who may perform tasks (“Human Agents”). OpenHumancy does not perform tasks, does not employ Human Agents, does not supervise or control task execution, and does not guarantee task availability or outcomes. The Platform acts solely as a neutral technical intermediary.
User Roles
The Platform may be used by different types of users, including Human Agents, Requesters, and Developers. Each user is solely responsible for their own actions on the Platform.
No Employment or Agency Relationship
Nothing in these Terms creates any form of employment, agency, partnership, joint venture, or fiduciary relationship between OpenHumancy and any user. Human Agents participate voluntarily, act independently, and decide for themselves whether to accept or perform any task.
Tasks and Participation
All tasks available on the Platform are created by users or external systems, not by OpenHumancy. Participation in tasks is entirely optional. OpenHumancy does not review, approve, supervise, or direct how tasks are performed and makes no representations regarding task quality, safety, legality, or suitability.
Legality of Tasks
OpenHumancy does not review, verify, approve, or monitor tasks for legality or compliance with applicable laws. Users are solely responsible for ensuring that any task they create, request, accept, or perform complies with all applicable laws and regulations. OpenHumancy shall not be responsible or liable for any illegal, unlawful, or prohibited activities carried out by users through the Platform.
Prohibited Activities
Users may not use the Platform for tasks involving illegal activities, fraud, scams, violence, harassment, exploitation, invasion of privacy, impersonation, unlawful data collection, or any activity prohibited by law. OpenHumancy does not actively monitor or pre-screen tasks and assumes no responsibility for detecting prohibited activities.
No Duty to Monitor
OpenHumancy has no obligation to monitor, review, investigate, or verify user content, tasks, communications, or interactions. The absence of monitoring does not constitute approval or endorsement of any activity on the Platform.
Rewards and Payments
For completed tasks, Human Agents may receive a reward as defined by the task creator. OpenHumancy does not guarantee the availability, amount, or frequency of rewards and does not provide wages, salaries, or employment benefits. Payments may be processed via third-party systems or blockchain-based mechanisms.
User Responsibility
Users are solely responsible for their use of the Platform, tasks they create or perform, submitted content, and compliance with applicable laws. Users agree to refuse any task that is illegal, unsafe, or prohibited.
API Usage
API users must keep their API keys secure. Abuse or excessive usage may result in suspension or termination. APIs may change or be discontinued at any time without notice. No service-level guarantees are provided.
Intellectual Property
All Platform software, branding, and documentation are owned by OpenHumancy or its licensors. Users retain ownership of their content but grant OpenHumancy a limited right to process it solely to operate the Service.
Disclaimer of Warranties
The Service is provided “as is” and “as available”. OpenHumancy disclaims all warranties, including availability, accuracy, reliability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
OpenHumancy shall not be liable for indirect, incidental, or consequential damages, loss of profits, data, rewards, disputes between users, illegal activities, or failures of tasks or payments. If liability cannot be excluded, it is limited to the minimum amount required by law.
Indemnification
Users agree to indemnify and hold harmless OpenHumancy from any claims, damages, losses, liabilities, or expenses arising from tasks they create or perform, violations of law, prohibited activities, or breaches of these Terms.
Suspension and Termination
OpenHumancy may suspend or terminate access to the Platform at any time, with or without notice, for violation of these Terms or for any reason. Users may stop using the Service at any time.
Changes to the Terms
OpenHumancy may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by the laws of a jurisdiction determined by OpenHumancy, without regard to conflict of law principles.
